Terms & Conditions of Sale


Every effort is made to ensure that the finished garment is accurate in detail to the original design as humanly possible with the following consideration;  As every garment is custom made to an individual’s specific measurements, the scaling and proportions of the finished garment 'may' differ from that of the original design as those proportions are adjusted.  This may be more apparent in group costumes whereby you have individuals of significantly different measurements. While scaling is often not an issue, we cannot be responsible for the results caused by the effects of scaling as it relates to any one individual’s measurements.  Please ask about the effects of scaling if you would like further clarification on its effects.     


In rare instances should a backorder of fabric or trim occur from a supplier that may jeopardize our production schedule and delivery commitment to our customer, we reserve the right to substitute materials if necessary with those of equal or greater value.  Customers will be contacted in advance for approval if this change is necessary. 


Are to be submitted to us in writing for all production orders on “our” forms and as per our measuring charts and instructions supplied.  We cannot take or process orders with verbal measurements.  Please note that we are not responsible for errors due to inaccurate measurements submitted to us.

Lead Times & Ready Dates

During peak seasons orders generally require you to book months in advance of your required date.  Our scheduling permits that all orders are ready on or before required dates, however circumstances beyond our control may delay orders beyond those dates. Rush orders may be subject to a surcharge and customers will be notified of such charges prior to ordering. Trailing orders, additions and/or increases in quantities cannot be guaranteed to be ready with initial orders.


To protect the required dates of our customers our production schedules are created and forecasted on a “first in” – “first-out” basis.  We will not jeopardize customer’s ready dates by squeezing or bumping orders between our production schedules. This “fair for all policy” will be strictly adhered to.    

Changes & Cancellations

Prior to production must be submitted in writing. Orders cannot be changed or cancelled once production has begun.    


Minor alterations will be performed free of charge by Kats Designs when returned to our premises in Markham, Ontario.  Alterations will be performed on a timely basis and when ready will be made available for pick-up during regular business hours.  A minor alteration is an alteration that is deemed to take less than 10-minutes per garment to perform.

Major alterations required due to incorrect measurements submitted to us, will be quoted in advance and charged based upon the work to be done.  All chargeable alterations will be quoted in advance for approval and are to be paid in full upon pick-up.  If shipping and insurance is required to return and re-ship an altered item, the cost of such will be paid by the customer.  If alterations are required due to our error, we shall arrange pick up and return of your item at our cost.  For local customers alterations are by appointment only.


All of our apparel is custom made and cannot be returned for partial or full credit for any reason whatsoever.  Should you have a valid concern with a garment you have received, we will offer a concise and quick remedy that may include return to our facility for correction, modification or extreme cases, replacement.  Please note that all requests for a return for any reason whatsoever, requires prior authorization from us.  


All orders are pick-up unless specified by customer.  Delivery orders will be shipped and tracked by a carrier of our choice and will be prepaid and charged F.O.B. Markham, Ontario.  We cannot be responsible for loss or damage if optional insurance is waived by the customer.  We ship to physical addresses only and do not ship to P.O. boxes.  International orders may be subject to customs clearance, taxes and import duties.  Payment of such taxes and duties if applicable are the responsibility of the customer.

Quotations & Pricing

Prices are quoted and are to be paid in Canadian dollars and are firm for 30-days prior to confirming orders. Orders are subject to applicable taxes prevailing at time of order.  Rebates and promotions cannot be combined for additional discounts. 


A 50% non-refundable deposit is required with a confirmed order and balance is to be paid in full upon completion. Orders cannot be picked up or shipped without payment in full.  For orders under $1,000.00CDN we accept Visa, MasterCard, American Express, Discovery Card, Debit Cards (Onsite Only), Cash and Cheque .  Over $1,500.00 we accept company cheques, money orders or bank drafts.  Any NSF cheques are subject to a $25.00 bank surcharge of which must be reimbursed to us by the customer.  Merchandise remains the property of Kats Designs until paid in full.


All of our apparel is manufactured from the finest materials and to the highest standards of quality and workmanship.  If by our determination any item that is deemed to be defective, shall be repaired or replaced free of charge for up to 30-days from date of purchase.  We cannot guarantee or warranty any item that has been misused or incorrectly cared for and our warranty is limited to manufacturing defects only.
